I think you're treading on thin ice. To my knowledge ANY copyrighted music must be cleared before using it in any form whatsoever, most especially for commercials! Even non-profits can't use copyrighted music without obtaining clearance (such as in a church). In the religious groups that I'm a part of, they all pay annual licensing fees to use praise songs and so on.

It's absolutely not worth the risk, what with the great, and affordable, production libraries out there today. Plus, as a musician who has a c.d. out there, I just think it's unethical to use someone else's music without permission. Fortunately I can also create my own soundtracks since I AM a musician, so that helps quite a bit.

I agree with Scott, Chris. I've never heard of this "15 seconds is okay" part of copyright law. Sounds to me like a line that was created by a radio salesperson so their client could use their favourite song on their commercial. Here in Canada at least a violation of copyright is the same whether it's 15 seconds or 3 minutes.

Hi Chris and all. Regarding copyright laws and music. Whether you are making money or not it is Illegal to use unless you have explicit consent in writing.
Even Remix artists have to pay royalties if using a 2 second splice from
a song. Look at Maddona, she has been sued in the past for using copyright protected material in her songs. Even if you think it's something
that no one will be able to recognize you take a big risk.

Sample CD's or Loop Libraries exist online. Here are a few links.
Alternatively check out theses magazines :
Future Music.
Computer Music
Music Tech (Best Sample Selection).

These are just three of the most comon magazines read by producers, and they come with copyright free loops. They are roughly $20.00 cdn
per mag, but will help you to improve your production skills as well.
Worth the investment.

Hopefully this is an appropriate thread to ask but in terms of the music. Let's say that you are chosen for a radio spot. Are you required to do the production such as adding the music and sounds, or is that left to the sponsor after they accept your read? Does it vary?

Chris - I think the :60 second rule you're thinking of has to do with radio broadcast and ASCAP/BMI. If you play it for less than :60 seconds you don't have to log it.

Yes, from my other posts you can guess I'm a slow learner.

Am I right in thinking that having purchased royalty free music, I can now use it without having to pay every time it plays. Does that also cover the company that will be airing that piece of copy?

Also, I use pro-tools, I'm a bit confused with looping, when my music is to short for the copy I have been copying and pasting the same piece, is there a way in pro-tools to do this automatically?

Well what about radio bumper music. I know that it can be played without consent.

Chrissy Hynde demanded Limbaugh stop using "back to ohio" as his main bumper, but he is still doing it.

How does that work?

Scott is correct,

I just had this conversation with some legal people about 2 months ago.
I had heard the :15 rule as well which was deemed "Public Domain". The legal folks say that is crap. I have a client who uses copyrighted music in his commercials. We don't produce them....we just air them. I was informed we need to have the client sign off stating the appropriate measures were taken to authorize use.

I am new here and thought I would make my first post in reply to the Rush Limbaugh issue. You know, just to get my feet wet.
